CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-36~ <br /> <br /> RESOLUTION ESTABLISHING TIE VOTE POLICIES <br /> FOR THE CITY COUNCIL <br /> <br />WHEREAS, on June 6, 1989, the City Council adopted <br /> Resolution No. 89-261 concerning a policy for tie <br /> votes; and <br /> <br />WHEREAS, the City Attorney presented his report (SR 89:351) <br /> concerning the need to clarify the policy in some <br /> respects. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Resolution No. 89-261, concerning a policy for <br /> tie votes, is hereby rescinded. <br /> <br />Section 2: The following policies are adopted in the event <br /> of a tie vote: <br /> <br /> "1. If all Councilmembers are not present, a tie <br /> vote on a motion shall be carried forward to <br /> the next meeting at which all Councilmembers <br /> are present. <br /> <br /> 2. If all Councilmembers are present but one <br /> Councilmember is required to abstain: <br /> <br /> A. With respect to any matter in which the <br /> City Council is required by law to take <br /> final action, a tie vote on a motion <br /> shall be considered a defeated motion. <br /> <br /> B. With respect to any matter on which the <br /> City Council is considering the matter on <br /> an appeal, a tie vote on a motion shall <br /> be deemed no action and the decision <br /> which was appealed shall stand. <br /> <br /> Any person whose application is denied as a <br /> result of this policy may reapply in <br /> accordance with the provisions of the <br /> Pleasanton Municipal Code. Nothing contained <br /> in this policy shall prohibit a Councilmember <br /> from participating in a decision involving a <br /> resubmitted application if the Councilmember <br /> is no longer required to abstain." <br /> <br /> <br />
