Resolution No. 89-339 <br />Page Two <br /> <br />Section 1: The City Council supports Option 3 of the above- <br /> captioned staff report as set forth above, with the <br /> added condition that no package sewer plant shall <br /> be used in connection with the development. <br /> <br />Section 2: The City Council requests that annexation <br /> procedures for this property be commenced <br /> immediately, based on the information provided to <br /> the Council by the developer's representative. <br /> <br />Section 3: In the event the City determines to annex this <br /> property, the City Council <br /> <br /> (a) does not intend to be bound by any tentative <br /> map, development plan or development agreement <br /> filed with, or approved by, the County of <br /> Alameda, <br /> <br /> (b) reserves the right to review any proposed <br /> development plan for the property and to make <br /> desired changes thereto and <br /> <br /> (c) authorizes the City Manager to enter into an <br /> Agreement with the property owner by which the <br /> property owner waives any rights he has with <br /> respect to Government Code Section 66413. <br /> <br />Section 4: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED AUGUST 1, 1989 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: Councilmembers - Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br />ABSENT: None ~~ <br />ABSTAIN: None ~ <br /> KENNETH R. <br /> <br />Ja{a~ ~.'
