EXHIBIT B CONDITIONS OF APPROVAL PUD-81-25-07M, Pleasanton Gateway/Home Depot 3450 Stanley Boulevard May 15, 2007 1. All applicable conditions of Case PUD-81-25 and successive modifications shall remain in full force and effect unless otherwise modified by the following requirements. 2. This approval will lapse within one year from the date of approval unless a building permit is issued for the development covered by these approvals, construction has commenced, and is diligently pursued toward completion or the City has approved an extension. 3. The site development standards for this development shall be those shown on the development plans, Exhibit A, dated "Received December 5, 2006" on file with the Planning Department, except as modified by the conditions of approval for PDR-529, Resolution No. 07-127, dated May 15, 2007. 4. Regency Partners, its successors in interest, or the property owners association or similar entity, by use of an on-site monitor or otherwise, shall be responsible for ensuring that all delivery trucks serving the shopping center shall use a route to/from State Route 84 and Stanley Boulevard and shall not use other Pleasanton streets. There shall be no truck deliveries or the loading/off-loading of delivery trucks between the hours of 10:00 p.m. and 6:00 a.m., and between the hours of 8:00 p.m. and 10:00 p.m. on Fridays and between 8:00 a.m. to 1:00 p.m. on Saturdays. All delivery trucks using the rear service area of the shopping center shall use the 105-foot diameter truck turn-around provided at the southeast area of the site and shall exit the site at Stanley Boulevard. City Code Enforcement and/or Police Department staff shall periodically review compliance with this condition. If the on-site monitor or other method is not successful in bringing about compliance with this condition, planning staff, in consultation with the property owner or their representatives, will devise an alternative method that achieves compliance. 5. Regency Partners, its successors in interest, or the property owners association or similar entity, by use of an on-site monitor or otherwise, shall be responsible for ensuring that: a. The haul route for all construction equipment and materials to/from this development shall be via State Route 84 and Stanley Boulevard and shall be subject to approval by the City Engineer prior to the issuance of a Page 1 of 4
