CITY COUNCIL OF THE CITY OF PLEASANTON c,o <br /> <br /> ALAMEDA COUNTY, CALIFORNIA ,c- <br /> RESOLUTION NO. 99-034 .r <br /> <br /> RESOLUTION APPROVING THE ABANDONMENT OF A <br /> PORTION OF BLESSING DRIVE WITHIN TRACT 6400 AND <br /> ACCEPTING PROPERTY FOR A NEW ROADWAY <br /> EXTENSION <br /> <br />WHEREAS, at its meeting of April 6, 1999, Council reviewed the staff report (SR 99:95) from <br /> the Director of Public Works recommending abandoning (a) a 4,472 sq. R. portion <br /> of the public right-of-way on Blessing Drive, (b) a 26 it. wide public access and <br /> utility easement, and (c) an eight R. wide public service easement adjacent to lots <br /> 42 through 45, and adjacent to parcels "I" and "N" of Tract 6400, more particularly <br /> described on Exhibit "A", attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, this right-of-way and easements are not required for public service, street or <br /> pedestrian pu~oscs; and <br /> <br />WHEREAS, the City is in receipt of a grant deed for a new roadway extension including eight <br /> foot wide public service easements on both sides of the street; and <br /> <br />WHEREAS, acceptance of this property for street and public easement purposes is in the public <br /> interest: <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the <br /> findings above establishing that the right-of-way is not required for street or <br /> pedestrian purposes or for public service easement pml~oses pursuant to Section <br /> 8333 and 8334 of the Streets and Highways Code, the public right-of-way and <br /> public service easements described in Exhibit "A" are hereby vacated. <br /> <br />Section 2: The grant deed from Presley Homes to the City of Pleasanton is hereby accepted. <br /> <br /> <br />
