MAINTENANCE AGREEMENT FOR ROADS WITHIN <br /> PLEASANTON TOWNSHIP COUNTY WATER DISTRICT <br /> ASSESSMENT DISTRICT #3 <br /> <br /> THIS AGREEMENT is entered into this __ day of__., 1999, by and <br />between the East Bay Regional Park District ("District") and the City of Pleasanton ("City"). <br /> <br /> RECITALS <br /> <br /> A. City, as successor in interest to the Pleasanton Township County Water District, holds <br />funds remaining within the Pleasanton Township County Water District Assessment District #3 fund. <br /> <br /> B. City has been advised by bond counsel that it is appropriate to use such remaining <br />funds for maintenance of roads within the original Assessment District #3. <br /> <br /> C. District owns property within the original Assessment District #3, and has been <br />expending its own funds to pay for maintenance of roads within this area. <br /> <br /> D. City and District desire to enter into an agreement to provide for the City to reimburse <br />the District for past and future expenditures related to roads within Assessment District #3. <br /> <br /> NOW, THEREFORE, in exchange for mutual consideration, the value of which is hereby <br />acknowledged, City and District agree as follows: <br /> <br />I. MAINTENANCE REIMBURSEMENT. <br /> <br /> a. If District desires to maintain roads under its jurisdiction located within the original <br /> Assessment District #3, as such roads are shown in the attached Exhibit A, attached <br /> hereto and incorporated herein by this reference, District shall track its expenditures <br /> related to such road maintenance and submit such information to City for <br /> reimbursement. <br /> <br /> b. City and District agree that City shall appropriate four thousand dollars ($4,000.00) <br /> each fiscal year from the Pleasanton Township County Water District Assessment <br /> District #3 fund to reimburse District for expenditures related to maintenance of such <br /> roads within Assessment District #3. District shall submit invoices to City for <br /> reimbursement, and City shall pay such invoices within thirty (30) days of receipt and <br /> verification. <br /> <br /> Each five (5) years during the term of this Agreement, the amount appropriated shall <br /> be increased by twenty-five percent (25%) to allow for increased costs due to inflation. <br /> <br /> c. If the District acquires other real property within the boundaries of the Assessment <br /> District #3, and the District chooses to perform maintenance and/or repair of roads <br /> within that property, City and District shall negotiate for an increased budget for <br /> <br /> Maintenance Agreement <br /> <br /> <br />
