CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 99-106 <br /> <br /> RESOLUTION DECLARING THE FUNDS WITHIN THE <br /> PLEASANTON TOWNSHIP COUNTY WATER DISTRICT <br /> ASSESSMENT DISTRICT #3 FUND AS SURPLUS AND <br /> DIRECTING THE FUNDS BE USED FOR MAINTENANCE <br /> OF ROADS WITHIN THE DISTRICT BOUNDARIES <br /> <br />WHEREAS, the Pleasanton Township County Water District (PTCWD) formed Assessment <br /> District #3 in the 1960's to pay for the construction of roads to serve its facilities; <br /> and <br /> <br />WHEREAS, some improvements were funded, but never constructed, leaving a balance in the <br /> Assessment District #3 fund which has gown since the City of Pleasanton <br /> assumed the assets and liabilities of the PTCWD; and <br /> <br />WHEREAS, it is legal and appropriate to use the balance in the Assessment District #3 fund for <br /> maintenance of roads within the district boundaries. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Declares as surplus the funds within the Pleasanton Township County Water <br /> District Assessment District #3 Fund (estimated as approximately $918,000) and <br /> directs that such funds be used for the maintenance of roads within the district <br /> boundaries. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
