ATTACHMENT 2 <br />RESOLUTION NO. 07- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A CONDITIONAL USE PERMIT FOR REGENCY CENTERS (DON <br />MACKENZIE AND PETE KNOEDLER)/HOME DEPOT, AS FILED UNDER <br />CASE PCUP-165 <br />WHEREAS, Regency Centers (Don MacKenzie and Pete Knoedler)/Home Depot <br />has applied for a conditional use permit to allow the construction of 193,481 square feet of <br />commercial area, including a Home Depot building supply sore and garden center, a <br />Longs Drugs pharmacy with drive-through, and miscellaneous neighborhood retail stores <br />including one drive-through, on an approximately 16-acre parcel located at 3450 Stanley <br />Boulevard, at the Valley Avenue/Bernal Avenue/Stanley Boulevard intersection, in the <br />Stanley Business Park; and <br />WHEREAS, zoning for the property is PUD--C (Planned Unit Development - <br />Commercial) District; and <br />WHEREAS, a duly noticed public hearing was held before the City Council on <br />February 20, 2007, at which time all pertinent testimony and documents were received; <br />and <br />WHEREAS, the City Council determined that the proposed conditional use <br />permit is consistent with the approval of similar use permits for other similar projects. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />SECTION 1. Approves Case PCUP-165, the application of Regency Centers (Don <br />MacKenzie and Pete Knoedler)/Home Depot for a conditional use permit to allow the <br />construction of 193,481 square feet of commercial area, including a Home Depot building <br />supply sore and garden center, a Longs Drugs pharmacy with drive-through, and <br />miscellaneous neighborhood retail stores including one drive-through, on an approximately <br />16-acre parcel located at 3450 Stanley Boulevard, at the Valley Avenue/Bernal <br />Avenue/Stanley Boulevard intersection, in the Stanley Business Park, subject to the <br />conditions of approval shown on Exhibit C, attached hereto and incorporated herein by this <br />reference. <br />SECTION 2. This resolution shall become effective upon the effective date of <br />Ordinance No. <br />PASSED, APPROVED, AND ADOPTED by the City Council of the City of <br />Pleasanton at a regular meeting held on May 15, 2007. <br />1 <br />
