ATTACHMENT 4 <br />RESOLUTION NO. 07- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF REGENCY <br />CENTERS (DON MACKENZIE AND PETE KNOEDLER)/HOME DEPOT, AS FILED <br />UNDER CASE PCUP-165/PDR-529/PUD-81-25-7M <br />WHEREAS, at its meeting of May 15, 2007, the City Council received a <br />proposed Negative Declaration for the application of Regency Centers (Don MacKenzie <br />and Pete Knoedler)/Home Depot for a PUD major modification, conditional use permit, and <br />design review approval to allow the construction of 193,481 square feet of commercial <br />area, including a Home Depot building supply sore and garden center, a Longs Drugs <br />pharmacy with drive-through, and miscellaneous neighborhood retail stores including one <br />drive-through, on an approximately 16-acre parcel located at 3450 Stanley Boulevard, at <br />the Valley Avenue/Bernal Avenue/Stanley Boulevard intersection, in the Stanley Business <br />Park; and <br />WHEREAS, the City Council received and reviewed the Initial Study, dated <br />November 8, 2006, and received the recommendations of the staff and Planning <br />Commission; and <br />WHEREAS, a duly noticed public hearing was held on May 15, 2007, at which <br />time the public was given the opportunity to comment on the environmental impacts of <br />the proposed project; and <br />WHEREAS, the City Council has reviewed the potential impacts in accordance <br />with the applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br />WHEREAS, the City Council finds that the proposed project would not have any <br />significant adverse effects on the environment; and <br />WHEREAS, the City Council further finds that the proposed project will have no <br />potential for adverse impacts on the site's wildlife. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />SECTION 1.
