ATTACHMENT 1 <br />ORDINANCE NO. <br />AN ORDINANCE APPROVING THE APPLICATION OF REGENCY CENTERS <br />(DON MACKENZIE AND PETE KNOEDLER)/HOME DEPOT FORA PUD <br />MAJOR MODIFICATION, AS FILED UNDER CASE PUD-81-25-7M <br />WHEREAS, Regency Centers (Don MacKenzie and Pete Knoedler)/Home <br />Depot has applied for a PUD major modification to allow the construction of <br />193,481 square feet of commercial area, including a Home Depot building supply <br />sore and garden center, a Longs Drugs pharmacy with drive-through, and <br />miscellaneous neighborhood retail stores including one drive-through, on an <br />approximately 16-acre parcel located at 3450 Stanley Boulevard, at the Valley <br />Avenue/Bernal Avenue/Stanley Boulevard intersection, in the Stanley Business <br />Park; and <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - <br />Commercial) District; and <br />WHEREAS, based on the Initial Environmental Study and pursuant to Resolution <br />No. ,the City Council adopted the Negative Declaration for the proposed project at <br />its meeting of May 15, 2007; and <br />WHEREAS, pursuant to Resolution No. and Resolution No. ,the City <br />Council approved the application of Regency Centers (Don MacKenzie and Pete <br />Knoedler)/Home Depot for a conditional use permit and design review approval, <br />respectively, to allow the construction of 193,481 square feet of commercial area, <br />including a Home Depot building supply sore and garden center, a Longs Drugs <br />pharmacy with drive-through, and miscellaneous neighborhood retail stores including <br />one drive-through at the subject site; and <br />WHEREAS, the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD major modification for the subject site; and <br />WHEREAS,the City Council finds that the PUD MAJOR modification is consistent <br />with the General Plan policies and the purposes of the PUD ordinance of the City of <br />Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD-81-25-7M, the application of Regency <br />Centers (Don MacKenzie and Pete Knoedler)/Home Depot has applied for a <br />PUD major modification to allow the construction of 193,481 square feet of <br />commercial area, including a Home Depot building supply sore and garden <br />center, a Longs Drugs pharmacy with drive-through, and miscellaneous <br />
