or other development without the elevation certificate, other certifications or other <br />evidence of compliance required in this chapter is presumed to be in violation <br />until such time as that documentation is provided. (Ord. 1374 § 2 (part), 1989) <br />17.08.060 Applicability. <br />This chapter shall apply to all areas of special flood hazards within the jurisdiction <br />of the City. (Ord. 1374 § 2 (part), 1989) <br />17.08.070 Basis for establishing areas of special flood hazard. <br />The areas of special flood hazard identified by the Federal Emergency <br />Management Agency or Federal Insurance Administration in a scientific and <br />engineering report entitled "The Flood Insurance Study for the City of <br />Pleasanton," dated September 19, 1984 and as revised thereafter, with an <br />accompanying Flood Insurance Rate Map is adopted by reference and declared <br />to be a part of this chapter. The Flood Insurance Study is on file at 200 Old <br />Bernal Avenue, Pleasanton, California. This Flood Insurance Study is the <br />minimum area of applicability of this chapter and may be supplemented by <br />studies for other areas which allow implementation of this chapter and which are <br />recommended to the City Council by the Floodplain Administrator. (Ord. 1374 § 2 <br />(part), 1989) <br />The City hereby includes Alameda County FIRM No. 060001 0115C under its <br />jurisdiction for floodplain management within the City of Pleasanton's City limits. <br />When the City of Pleasanton's base flood elevations either increase or decrease <br />resulting from physical changes affecting flooding conditions, as soon as <br />practicable, but not later than six months after the date such information <br />becomes available, the City of Pleasanton will submit the technical or scientific <br />data to FEMA. Such submissions are necessary so that upon confirmation of the <br />physical changes affecting flooding conditions, risk premium rates and flood plain <br />management requirements will be based upon current data. <br />17.08.080 Compliance. <br />No structure or land shall hereafter be constructed, located, extended, converted <br />or altered without full compliance with the terms of this chapter and other <br />applicable regulations. Violations of the provisions of this chapter by failure to <br />comply with any of its requirements (including violations of conditions and <br />safeguards established in connection with conditions) shall constitute a <br />misdemeanor. Nothing herein shall prevent the City Council from taking such <br />lawful action as is necessary to prevent or remedy any violation.
