CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 90-230 RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL (AP-90-14) AND UPHOLDING A DECISION OF THE DESIGN REVIEW BOARD WHICH APPROVED CASE Z-90-74 WHEREAS, at its meeting of August 23, 1990, the Design Review Board approved the application by Chevron USA for design review approval, Z-90-74, to replace a full-service automobile and repair station with a 24-hour self-service gasoline station, a 920 sq. ft. convenience market, and an automatic drive-through car wash with blower dryer on an approximately 24,543 sq. ft. site located at 5280 Hopyard Road; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council of Pleasanton submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, a public hearing was held before the city Council on December 11, 1990 at which time all pertinent testimony was heard and relevant documents were reviewed; and WHEREAS, based on the preponderance of evidence, the City Council finds that the proposed service station design would be attractive in terms of building architecture and landscaping and would be compatible with the surrounding area. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The appeal of Case Z-90-74, the application of Chevron USA for design review approval to replace a full- service automobile and repair station with a 24-hour self-service gasoline station, a 920 sq. ft. convenience market, and an automatic drive-through car wash with blower dryer on an approximately 24,543 sq. ft. site located at 5280 Hopyard Road (AP-90-140), is denied and approval of the application is granted, subject to the conditions of approval as shown in the Design Review Board Resolution No. DR-90-72, a copy of which is attached hereto and incorporated herein by this reference. Section 2 : This resolution shall become effective immediately upon its passage and adoption.
