CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-230 <br /> <br />RESOLUTION DENYING THE APPEAL OF THE CITY <br />COUNCIL (AP-90-14) AND UPHOLDING A DECISION OF <br />THE DESIGN REVIEW BOARD WHICH APPROVED CASE <br />Z-90-74 <br /> <br />WHEREAS, <br /> <br />at its meeting of August 23, 1990, the Design Review <br />Board approved the application by Chevron USA for design <br />review approval, Z-90-74, to replace a full-service <br />automobile and repair station with a 24-hour self-service <br />gasoline station, a 920 sq. ft. convenience market, and <br />an automatic drive-through car wash with blower dryer on <br />an approximately 24,543 sq. ft. site located at 5280 <br />Hopyard Road; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal <br />Code, the City Council of Pleasanton submitted an appeal <br />to the City Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held before the city Council on <br />December 11, 1990 at which time all pertinent testimony <br />was heard and relevant documents were reviewed; and <br /> <br />WHEREAS, <br /> <br />based on the preponderance of evidence, the City Council <br />finds that the proposed service station design would be <br />attractive in terms of building architecture and <br />landscaping and would be compatible with the surrounding <br />area. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The appeal of Case Z-90-74, the application of <br />Chevron USA for design review approval to replace a full- <br />service automobile and repair station with a 24-hour <br />self-service gasoline station, a 920 sq. ft. convenience <br />market, and an automatic drive-through car wash with <br />blower dryer on an approximately 24,543 sq. ft. site <br />located at 5280 Hopyard Road (AP-90-140), is denied and <br />approval of the application is granted, subject to the <br />conditions of approval as shown in the Design Review <br />Board Resolution No. DR-90-72, a copy of which is <br />attached hereto and incorporated herein by this <br />reference. <br /> <br />Section 2 : This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
