No. 986 Noes: <br />There being no problems, a resolution Absent: x x <br />recommending the one-year time extension Abstain: <br />was entered and passed. <br />The Planning Director also read a memoran- <br />dum from the City Manager regarding the <br />denial of City Council for Mackay Homes' <br />request for the C-N zoning in their tract <br />off Hopyard Road. <br />A communication was also received from Motion: <br />Falender Homes requesting permission to Seconded: <br />deviate from the condition of approval for Ayes: <br />their P.U.D., wherein specific elevations Noes: <br />were to be anchored to specific lots. Absent: <br />Abstain: <br />Mr. Eline explained to the Commission that <br />this type of arrangement poses severe <br />problems for the developer regarding the sa e <br />of the homes. <br />A motion was passed authorizing the staff <br />to work with Falender Homes regarding the <br />varying of certain elevation plans, where <br />necessary, to change the original approval <br />of the PUD. <br />The Planning Director also advised the <br />Commission that a "loophole" was discovered <br />in the ordinance regarding corner lots as <br />pertaining to Sec. 2.103(f). <br />The Planning Director advised that this <br />matter would be discussed with the City <br />Attorney and addresses will be furnished, <br />so that the Commissioners may view this <br />particular problem as they apply to specifi <br />cases. <br />- 3 - <br />
