CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 90-203 <br /> <br />RESOLUTION AUTHORIZING SETTT.RMFNT OF WALIJkCK <br />CAMPAIGN COMMITTEE, ET AL. V. CITY OF <br />Pr.~.AS/~NTON <br /> <br />WHEREAS <br /> <br />in 1981, the City Council adopted a comprehensive <br />ordinance concerning political signs; and <br /> <br />WHEREAS, <br /> <br />in adopting that ordinance, the Council found that the <br />purpose of the ordinance was to protect the public from <br />traffic safety hazards, structural sign hazards, <br />aesthetic blight, litter, etc., yet to protect the rights <br />of political candidates and those wishing to support <br />candidates or ballot measures; and <br /> <br />WHEREAS, <br /> <br />to carry out that purpose, the ordinance provides in part <br />that it is unlawful to post a political campaign sign <br />more than 30 days prior to the election for which the <br />sign is posted; and <br /> <br />WHEREAS, <br /> <br />this portion of the ordinance has been challenged in the <br />United States District Court, Northern District of <br />California, in an action entitled Wallack Campaign <br />C0 .mmittee, et al. v. Members of the City Council of the <br />City of Pleasanton, et al; and <br /> <br />WHEREAS, <br /> <br />the city Council has initiated an amendment to Section <br />18.100.060 of the Pleasanton Municipal Code to delete the <br />30-day requirement concerning the posting of political <br />campaign signs prior to an election; and <br /> <br />WHEREAS, <br /> <br />staff has recommended that the above-entitled action be <br />settled pursuant to a Stipulated Judgment because it <br />would not be the best use of the City's time or resources <br />to continue to litigate this matter. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Attorney is authorized to sign the attached <br /> Stipulation such that a Judgment, in a form attached to <br /> the Stipulation, may be entered against the City of <br /> Pleasanton, enjoining the City from enforcing that <br /> portion of the City's political sign ordinance <br /> prohibiting the posting of campaign signs more than 30 <br /> days prior to an election. <br /> <br /> <br />
