CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 90-203 RESOLUTION AUTHORIZING SETTT.RMFNT OF WALIJkCK CAMPAIGN COMMITTEE, ET AL. V. CITY OF Pr.~.AS/~NTON WHEREAS in 1981, the City Council adopted a comprehensive ordinance concerning political signs; and WHEREAS, in adopting that ordinance, the Council found that the purpose of the ordinance was to protect the public from traffic safety hazards, structural sign hazards, aesthetic blight, litter, etc., yet to protect the rights of political candidates and those wishing to support candidates or ballot measures; and WHEREAS, to carry out that purpose, the ordinance provides in part that it is unlawful to post a political campaign sign more than 30 days prior to the election for which the sign is posted; and WHEREAS, this portion of the ordinance has been challenged in the United States District Court, Northern District of California, in an action entitled Wallack Campaign C0 .mmittee, et al. v. Members of the City Council of the City of Pleasanton, et al; and WHEREAS, the city Council has initiated an amendment to Section 18.100.060 of the Pleasanton Municipal Code to delete the 30-day requirement concerning the posting of political campaign signs prior to an election; and WHEREAS, staff has recommended that the above-entitled action be settled pursuant to a Stipulated Judgment because it would not be the best use of the City's time or resources to continue to litigate this matter. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Attorney is authorized to sign the attached Stipulation such that a Judgment, in a form attached to the Stipulation, may be entered against the City of Pleasanton, enjoining the City from enforcing that portion of the City's political sign ordinance prohibiting the posting of campaign signs more than 30 days prior to an election.
