Kreske and Robert J. <br />COUNCIL Myers - request of City Councilfor Commissio <br />to reconsider conditions imposed on this <br />permit with the intent to further impose <br />additional conditions. <br />The City Attorney had some suggestions by <br />which the Commission could impose further <br />control on the development. <br />That if the develgxnent is not well underway <br />within one year, that the conditional use <br />permit would lapse. <br />The Commission did not approve of this metho <br />and preferred to have the zoning revert back <br />to the RM-4dJJ District. <br />The City Attorney further suggested that the <br />Commission impose a condition on this use <br />whereby the applicant not be permitted to <br />apply fora use or permit for any other use <br />allowed under the P (Public and Institutions ) <br />District for a period of at least 6C days <br />from the lapse of the conditional use permit <br />for the convalescent hospital. This would <br />permit the Commission to initiate rezoning <br />of the parcel to the S (Study) District. <br />Also, this should come in writing in an <br />agreement form from the owner of the propert <br />- Dr. Levine. <br />The City Attorney suggested that the <br />Commission take action implementing the <br />Council's suggestion, and also with the con- <br />sent of the owner of the property. <br />The City Attorney advised that he can insti- <br />tute proceedings immediately to rezone the <br />property after the conditional use permit <br />expires. <br />The Planning Commission, after further <br />deliberation, reached the decision to not <br />forward any recommendation to the City <br />Council regarding this ma tter. <br />- 12 - <br />
