He also <br />asked the City Attorney if the City <br />would find itself in trouble by de- <br />signating certain lands zoned Agri- <br />cultural as Open Space? Mr. Scheidi <br />replied that the City would have <br />to provide some economic return <br />which may not be what the property <br />owner would feel is fair market valu <br />The fact that a person may own pro- <br />perty on the basis that he will some <br />day be able to develop at a higher <br />density, does not give him a vested <br />right. <br />Further discussion followed on the <br />question of varying degrees of <br />substantial reliance. <br />Commissioner Pons questioned how the <br />property owners were affected by the <br />Pleasanton Township Water Assessment <br />District. The City Attorney indi- <br />cated that these people did not ob- <br />ject when they could at the time thi <br />water district was formed. <br />The reason for the formation of the <br />water district was to provide water <br />to the Kilkare Woods area, said <br />Mr. Jim Walker, Assistant to the <br />City Manager. <br />A resolution was then entered and <br />adopted accepting the Conservation <br />and Land Use Element with the foil <br />ing changes noted for Pages 6, 9, <br />25. <br />At the conclusion of the review of <br />-28- <br />
