C. & R.'s be drafted by Mr. <br />Lewis and submitted to the City <br />Attorney for review and thence to they <br />Planning Commission for their review;E <br />that Secretary Harris discuss with <br />the City Manager the legality of <br />reviewing tentative maps and direc- <br />tion from City Council on this. <br />The Commission was reminded of the <br />special meeting on the preliminary <br />budget the following evening at the <br />Justice Court. <br />that the ruling, while not invali- <br />dating the act for. the entire state, <br />*-, Tw <br />could be dispensecl~within a given. <br />county. It was his understanding <br />that an appeal had been filed in <br />Nevada County. He had been unsuc- <br />cessful in contacting the City <br />Attorney regarding some opinion from <br />him. He wondered about filing an <br />appeal, or at least ask Superior <br />Court to file for Alameda County <br />until the suit in Nevada County is <br />settled. Chairman Pereira had no <br />feeling one way or the other on this, <br />but asked Secretary Harris to get a <br />legal opinion from our City Attorney <br />in writing for their information. <br />Harris replied that the City Attorney <br />would be busy for some time attending <br />Commissioner Carrigan made reference <br />to the recent Government Code 3700, <br />et seq. (Moscone) Disclosure of <br />Assets form, which needed to be filedi <br />in April. There was some indication <br />-14- <br />
