Planning Commission <br />Page 7 <br />5/26/82 <br />Commissioner Wilson asked if it actually could be accomplished in nine <br />months. Mr. Warnick said that one project has yet to be designed and <br />finalized but that they are moving ahead with the rest. <br />Commissioner Wilson said he had a condition imposed on the Hacienda project <br />that no building permits could be acquired until the assessment district <br />is levied and asked Mr. Warnick if he thought this condition would <br />stand. Mr. Warnick said he would expect the developers to ask that it <br />be removed. <br />Commissioner Wilson asked if Mr. Warnick foresaw any problems for the City. <br />Mr. Warnick said that traffic control conditions are imposed on project <br />approval and should give the City all of the control they need. Commissioner <br />Wilson asked about lawsuit in the- event the assessment district went up <br />in smoke and asked whose responsibility it would be. Mr. Warnick said the <br />City would allow them to build and the project is bonded. <br />Mr. Swift stated that the City Council approved the second stage of <br />Hopyard Road at their 5/24/82 meeting. He said the projects are bonded so <br />if Hacienda walked away the City could attempt to recover the cost through <br />bonds. He said it would be different if the project weren't started. He <br />further said they have agreements with. the developer. <br />Commissioner Wilson then asked what would happen if Hacienda's improvements <br />benefit other lands and they are unable to go ahead with building, he asked <br />if the City would have any contingent liability for this. Mr. Swift said <br />they could try to get reimbursed. He said there are cases where properties <br />have paid into an assessment district and the City rezoned property so <br />that they had no way to use the improvements paid for and this would justify <br />a lawsuit. <br />Commissioner Wilson said he hopes the assessment district gets approved <br />and there are no problems down the line. <br />Mr. Warnick indicated that at the present time 72~ of the areas have signed <br />up and accepted by the City Council and is final and even if 50o signed <br />petitions, four fiFths of the City Council vote can override that. <br />He said the most difficult thing is to be assured that all work we want <br />done on the freeways is done. <br />Commissioner Lindsey indicated he would like to comment on the excellent <br />job done by Mrs. Getty as Chairperson of the Planning Commission for the <br />past year.
