Mr. Levine explained that that' <br />document is an agreement between the <br />...developer and the homeowners and in <br />no way binds the City's responsi- <br />bility when acting on a zoning amend- <br />ment. <br />Mf'. Art Schumacher then spoke and <br />stated that his company is attempt- <br />ing to resolve these problems, which <br />in their opinion is not insurmount- <br />able. He had requested that the <br />proceedings continue since a delay <br />would mean further uncertainty as <br />to Stoneson's position regarding <br />sewer allocations. <br />The Public Hearing was closed. <br />Commissioner Butler brought up the <br />issue of how the townhouse home- <br />owners might be adversely affected, <br />monetarily, if the development plan <br />is altered. <br />Commissioner Butler then asked <br />whether or not development of the <br />subject property as 87 single family <br />homes, or something in excess of 140 <br />multiple units, would be affected <br />by the sewer allocations. Mr. Harris <br />replied that sewer allocations would <br />not be affected. <br />Commissioner Shepherd stated that in <br />light of the concerns expressed by <br />the homeowners, he had serious re- <br />servations about acting on this ap- <br />plication at this time. <br />-5- <br />
