DZS-77-5, Castlewood Ente~nrises <br />Review of negative declaration for a project to create four lots at the <br />southeast corner of Foothill Road and Bernal Avenue. <br />Secretary Harris explained the mitigation measures which would need to be <br />adopted in order for this project to qualify under the findings for a negative <br />declaration. He then read the five conditions comprising the mitigation <br />measures. <br />The Public Hearing was opened on the negative declaration. <br />Ted Fairfield and Dee Wilson were both present. Mr. Fairfield spoke to the <br />application. He requested that Condition No. 4 calling for staff design <br />approval of proposed residences, outbuildings, fences, etc., (including review <br />of elevations, colors, locations, etc.), be deleted. He cited that a regular <br />subdivision for construction of single family homes would not fall under <br />this requirement. <br />No one else spoke to the application and the Public Hearing was closed on <br />the negative declaration. <br />Considerable discussion ensued regarding Condition No. 4 and Commissioner <br />Jamieson was against the inclusion of this condition as he felt it would be <br />an infringement on the developer. Commissioner Doherty and Chairman Butler <br />tended to feel the same way. <br />Commissioner Shepherd did not feel this was an unreasonable request. Commiss- <br />ioner Wood indicated no fears on deleting the requirement providing he would <br />be assured that the present owners would remain as owners o.f the property and <br />would be developing the land. <br />Resolution 1523 was entered and adopted making the finding that the proposed <br />project could have an effect on the environment, but that with the necessary <br />mitigation measures would qualify for a negative declaration. However, the <br />Commissioners voted to delete Condition No. 4 from those conditions. <br />Roll Call Vote <br />Resolution: Jamieson <br />Seconded: Doherty <br />Ayes: Doherty, Jamieson, <br />Noes: Shepherd <br />Absent: None <br />Abstain: None <br />Wood, Chairman Butler <br />Application for subdivision approval to create four lots on 18.6 acres <br />located at the southeast corner of Foothill P.oad and Bernal Avenue; zoning <br />for the property is R-1-6500 (Single Family) District. <br />The Public Hearing was opened on the subdivision review. <br />Mr. Fairfield spoke on the conditions.
