One other service to be provided would be a certified Red Cross first aid <br />attendant on the premises at all times. <br />Commissioner Jamieson asked Deputy City Attorney about a "hold harmless" <br />clause or some provision which would absolve the City from any possible <br />liability. Mr. Levine replied that a condition could be attached to that <br />effect. Mr. Lawrence stated he believed his policy included such a clause <br />to the landlord and he thought it could also cover the City. <br />Commissioner Jamieson asked about provision of a demolition requirement to <br />safeguard the City should the park ever close down. Mr. Lawrence stated <br />that he is securing a $25,000 bond with the landlord to this effect. <br />The Public Hearing was closed on the conditional use review. <br />The Commissioners felt certain modifications should be made to the staff <br />recommendations. Commissioner Wood proposed that Condition #10 should be <br />amended to require the developer to provide a theft-proof bike rack on the <br />property; a condition requiring a hold harmless clause protecting the City <br />be added; and that Condition #4 be revised as noted above. The Chairman <br />suggested that the applicant consider painting a path on Johnson Industrial <br />Drive for bicyclists, the intent here being to encourage the developer to <br />work with the City Engineering department to consider providing some sort <br />of a road leading from Stoneridge Drive northerly to enter the park from <br />the west end. <br />Resolution No. 1527 was entered and adopted approving the conditional use <br />permit subject to the conditions in the staff report, plus amendments noted <br />in the foregoing. <br />Roll Call Vote <br />Resolution: Jamieson <br />Seconded: Shepherd <br />Ayes: Jamieson, Shepherd, Wood, Chairman Butler <br />Noes: None <br />Absent: Doherty <br />Abstain: None <br />UP-77-8, George Canessa - application for a conditional use permit to allow <br />a security guard to reside at a mini-warehouse facility to be located at <br />3716 Stanley Boulevard; zoning for the property is C-S (Commercial Service) <br />District. <br />The Public Hearing was opened. <br />Mr. Canessa was present to speak for the application. <br />Chairman Butler asked him about the possiblity of installing a chain link <br />fence around the abandoned swimming pool until construction begins. Mr. <br />Canessa replied that he is in the process of securing bank approval for the <br />development and would prefer not to make this commitment now since it will <br />be three to six weeks before he receives their answer. <br />The Public Hearing was then closed. <br />-4- <br />
