CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-183 <br /> <br />RESOLUTION UPHOLDING THE APPEAL OF THE CITY <br />COUNCIL OF A DECISION OF THE DESIGN REVIEW <br />BOARD, THEREBY DENYING THE APPLICATION OF <br />MANOJ DAVE' AS FIT~D UNDER AP-89-23 (CASE <br />Z-89-557) <br /> <br />WHEREAS, <br /> <br />on January 16, 1990, City Council conditionally approved <br />the application of Manoj Dave for design review approval <br />to construct a single-family residence on a hillside <br />residential development; and <br /> <br />WHEREAS,. one condition of that approval required that the <br /> landscaping to buffer views of the residence from the <br /> Valley floor be designed to achieve the screening effect <br /> depicted in a computer simulation submitted by the <br /> applicant to the City Council; and <br /> <br />WHEREAS, <br /> <br />the screening in the computer simulation depicted the <br />screening effect of trees once they had attained three to <br />five years of growth; and <br /> <br />WHEREAS, <br /> <br />the landscape plan was referred to the Design Review <br />Board, which after several sessions voted to approve the <br />landscaping plan but acknowledged that the time frame <br />necessary to achieve the screening depicted in the <br />computer simulation photograph would exceed five years by <br />several years; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal <br />Code, the City Council submitted an appeal to the City <br />Clerk of the City of Pleasanton concerning this approval; <br />and <br /> <br />WHEREAS, <br /> <br />a public hearing was held before the City Council on <br />October 2, 1990 at which time all pertinent testimony was <br />considered and documents were reviewed; and <br /> <br />WHEREAS, <br /> <br />this project is categorically exempt from the <br />requirements of California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, <br /> <br />based on the preponderance of evidence, the City Council <br />finds that the landscape plan and design approved by the <br />Design Review Board will not provide the level of <br />screening in the time frame (3-5 years) contemplated when <br />the Council conditionally approved the application to <br />construct the residence. <br /> <br /> <br />
