CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 90-183 RESOLUTION UPHOLDING THE APPEAL OF THE CITY COUNCIL OF A DECISION OF THE DESIGN REVIEW BOARD, THEREBY DENYING THE APPLICATION OF MANOJ DAVE' AS FIT~D UNDER AP-89-23 (CASE Z-89-557) WHEREAS, on January 16, 1990, City Council conditionally approved the application of Manoj Dave for design review approval to construct a single-family residence on a hillside residential development; and WHEREAS,. one condition of that approval required that the landscaping to buffer views of the residence from the Valley floor be designed to achieve the screening effect depicted in a computer simulation submitted by the applicant to the City Council; and WHEREAS, the screening in the computer simulation depicted the screening effect of trees once they had attained three to five years of growth; and WHEREAS, the landscape plan was referred to the Design Review Board, which after several sessions voted to approve the landscaping plan but acknowledged that the time frame necessary to achieve the screening depicted in the computer simulation photograph would exceed five years by several years; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council submitted an appeal to the City Clerk of the City of Pleasanton concerning this approval; and WHEREAS, a public hearing was held before the City Council on October 2, 1990 at which time all pertinent testimony was considered and documents were reviewed; and WHEREAS, this project is categorically exempt from the requirements of California Environmental Quality Act (CEQA); and WHEREAS, based on the preponderance of evidence, the City Council finds that the landscape plan and design approved by the Design Review Board will not provide the level of screening in the time frame (3-5 years) contemplated when the Council conditionally approved the application to construct the residence.
