CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-182 <br /> <br />RESOLUTION SUM~4A~ILY VACATING A PORTION OF <br />JO~/~SON DRIVE <br /> <br />WHEREAS, <br /> <br />pursuant to Chapter 4, Part 3, Division 9 of the <br />California Streets and Highways Code, the City Council <br />may summarily vacate excess right of way of a street or <br />highway, when not required for street or highway purposes <br />(Section 8334, Streets & Highways Code); and <br /> <br />WHEREAS, <br /> <br />a portion of Johnson Drive, as described in Exhibit A <br />attached to this resolution and incorporated herein by <br />reference, is no longer needed for right of way purposes <br />in that Johnson Drive in this area has been realigned and <br />relocated; and <br /> <br />WHEREAS, <br /> <br />public convenience and necessity require a reservation of <br />a public service easement as described in Exhibit "A", <br />over the area to be vacated. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> That portion of Johnson Drive, described in Exhibit A <br />attached to this resolution is hereby summarily vacated, <br />subject to the reservation of a public service easement <br />over the same area vacated. <br /> <br />Section 2: <br /> <br />The City Clerk is hereby authorized and directed to <br />cause a certified copy of this resolution of vacation to <br />be recorded in the office of the Alameda County Recorder. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
