There were no questions. <br />The Public Hearing was closed. <br />Resolution No. 1686 was adopted making the finding that the proposed use <br />permit, UP-78-21, would not have any significant adverse impacts on the <br />environment and that the negative declaration would be filed. <br />Roll Call Vote <br />Resolution: Geppert <br />Seconded: Doherty <br />Ayes: Geppert, Wilson and Acting Chairman Doherty <br />Noes: None <br />Absent: Getty and Chairman Jamieson <br />Abstain: None <br />Resolution No. 1687 was entered and adopted approving UP-78-21 subject <br />to the conditions as found in the staff report, 1 through 12, with <br />changes in conditions 2 and 6 which will now read as follows. With <br />condition number 12 being eliminated as it pertains only to Trinity <br />Lutheran Church. <br />2. That there be a play area approximately the size of the <br />area presently enclosed by the fencing on the site, that <br />this play area be completely enclosed by a fence and that <br />the fencing used be an extension of the 5' 6" wooden fence <br />which presently exists on the site and this fence shall come <br />no closer than 40 ft. to the northern property line of the <br />subject property. <br />6. That since the applicant intends to purchase the land on which <br />the parsonage is located, the applicant furnish the City of <br />Pleasanton with a copy of perpetual easement for access and <br />parking purposes which indicates that the nursery school has <br />exclusive use of at least 10 parking spaces in the church <br />parking lot during all hours of operation of the school; said <br />easement to be recorded in accordance with the requirements of <br />Section 2-9.23, Article 16, Chapter 2, Title II of the <br />Ordinance Code of the City of Pleasanton. <br />Roll Call Vote <br />Resolution: Doherty <br />Seconded: Wilson <br />Ayes: Geppert, Wilson and Acting Chairman Doherty <br />Noes: None <br />Absent: Getty and Chairman Jamieson <br />Abstain: None <br />Resolution No. 1688 was then adopted concerning Trinity Lutheran Church. <br />That because the subject property is owned by the Trinity Lutheran Church, <br />the church property is only partially landscaped and the terms of the <br />original conditional use permit for the church required that the entire <br />church property be landscaped prior to this time, all landscaping shown <br />-5- <br />..._.._ .. ~....__... .__....._._.. _. _.,......~_..~--T-_._. _. .. _......._ .._.,._.. __..._.. _.. _.. _.. <br />
