The public hearing was opened. <br />Ed McGovern, Longview Drive, representing the present residents of <br />Longview spoke regarding this development. He spoke in favor of this <br />proposal and read a list of homeowner conditions which he stated had <br />been agreed to by the developer. Mr. McGovern presented the list for <br />the file and record. He stated that this development would not hurt <br />the ridge as much as the 4-wheel drive and other vehicles which use this <br />land for recreation causing erosion and other problems. Commissioner <br />Doherty then inquired if this list was part of the CC&R's or whether <br />it was just a request of the homeowners. Mr. McGovern stated the items <br />on the list are not presently deed restrictions. Commissioner Wilson <br />asked Mr. McGovern how long he had lived in the Longview area and Mr. <br />McGovern responded since June, 1975 and that he has not had any cracks <br />in the walls and that his house was stable. He did say he did have a <br />soils report on the site. Pam Grove, 5555 San Jose Drive, spoke in <br />opposition to this project as she has concerns with the roads steepness <br />and is of the understanding it will be steeper than Santos Ranch Road and <br />would be bad particularly for fire projection in addition to setting <br />a bad precedent. She referred to an Army Corps of Engineers study <br />citing hazards of from 1 to 6 with Longview at a 6. The geologic report <br />and EIR show there are great problems. She stated the residents <br />wouldn't accept the responsibility of erosion of the road and other <br />problems caused by this development. <br />~reSc~n <br />Mike Drayson, 1590 Frisby, Concord, spoke. He stated he is a geologist <br />and is doing a thesis for his masters degree on the Pleasanton Ridge. <br />He stated he has done a landslide and geologic map of the area. He <br />stated he is concerned that approval of this project would set a pre- <br />cedent on the Pleasanton Ridge. He stated he has also prepared a <br />slope stability map of the area high on the ridge. He stated any <br />development would require cutting, filling of steep slopes effecting <br />the vegetation currently holding the soil in place. <br />Harold Cizler, a potential homeowner of this area spoke for this pro- <br />ject and the fact that proper borings and studies were done by Gribaldo, <br />Jacobs and Jones. Mr. Cizler stated the homeowners will be accepting <br />a large responsibility for the fire and protection of their homes, <br />there would be an increase in revenue to the City as opposed to expense <br />to them and that with regard to rough cuts, they have already been made. <br />He doesn't feel approval of this project is precedent setting. Dis- <br />cussion then ensued about geological studies being done on each site. <br />Chairman Jamieson pointed out there are many lawsuits going. on by <br />developers concerning movement of houses on flat land. Cizler stated <br />he feels a qualified geological firm could give an engineering report <br />requiring bonding should a house slip. <br />Chairman Jamieson then inquired as to whether or not anyone else wished <br />to speak. Daren Stevenson, Las Lomitas, spoke stating the 1968 report <br />stated there were borings made and they hit bedrock and that if a fire <br />truck couldn't get up the road provided, they couldn't get up anywhere. <br />He spoke totally in favor of the project. Gil Maines, 39465 Paseo <br />Padre Parkway, Suite 3410, Fremont, attorney for the applicant spoke <br />stating his applicant is not in accord with the recommendations and <br />findings of the staff and that this development started in 1965 with <br />Annexation No. 37 and there was approval for Tract 2892 for 68 acres. <br />He stated this was never finalized.
