Planning Commission <br />October 10, 1979 <br />Page 4 <br />as the utilities. He indicated the 95 acre initiation of rezoning was at the recommendation <br />of the Planning Commission. He explained briefly the two proposals before the Commission <br />concerning portions of this same property. He further stated a portion of the property is <br />owned by H. C. Elliott and that land had a Tentative Map. He stated the City can rezone <br />property that has a final map approval and that there is nothing prohibiting this property <br />from being rezoned. <br />The public hearing was opened. <br />Carol Smith, 3167 Gulf Stream asked for an explanation and locations concerning the 95 acre <br />proposal; the 8.8 acre proposal and the 27+ acre proposal. Mr. Harris explained using <br />the General Plan map. <br />Jim Keeney, 3471 Windsor Court spoke stating he was new to the area and asked if matters such <br />as this were ever put before a vote. Chairman Doherty explained. Mr. Keeney stated it <br />seemed strange to him that people living near the proposed school site have nothing to <br />say concerning the property's rezoning. Chairman Doherty explained that the school district <br />can't use the site. Mr. Harris explained what R-1-6500 meant to Mr. Keeney. He stated the <br />staff recommends R-1-8500 and/or R-1-10,000 for the area. <br />Victor Poree, Haines and Walker, Attorneys-at-law, representing H. C. Elliott spoke <br />in opposition to this rezoning because it eliminates moderate cost housing. Mr. Poree <br />stated they consider moderate housing to be $80,000-$100,000 at this time. <br />George Oakes spoke to the history of the Pleasanton Meadows Development and surrounding property. <br />He stated he didn't want litigation, he only wanted the City of Pleasanton to live up to their <br />agreements concerning future development. <br />Dave Clayton, 3111 Thistledown stated he was in favor of larger lots. He addressed concerns <br />with property values declining, sewer problems, etc. <br />Mrs. Frederick, 3479 Windsor Court spoke stating she wanted the school site to remain or <br />have larger lots. She stated smaller lots generate traffic problems and there are traffic <br />problems already in existence in this area. Mr. Oakes responded to Mrs. Frederick's <br />statements stating it was not their intention to have any smaller lots than the currently <br />developed surrounding properties. <br />The public hearing was closed. <br />Commissioner Wilson then made a motion that the proposed project would not have a significant <br />effect on the environment and that the negative declaration be approved as prepared for <br />RZ-79-15. This motion was seconded by Commissioner Getty. <br />ROLL CALL VOTE <br />Ayes Commissioners Getty, Jamieson, Wilson and Chairman Doherty <br />Noes None <br />Absent Commissioner Geppert <br />Resolution No. 1801 was then entered and adopted approving the negative declaration for <br />RZ-79-15. <br />Commissioner Jamieson then asked to what extent the curbs, gutters, utilities, etc. were <br />completed in this area and asked what kind of change the rezoning would have on the area <br />with these improvements started. Mr. Harris explained. Commissioner Jamieson further stated <br />perhaps the area should have had light industrial between the houses and the freeway. <br />Mr. Harris spoke (confirming with Mr. Oakes) that Tract 3148 has sewer, water and PG&E and <br />that Tract 3133 has a bridge and sewer interceptor. Mr. Oakes referred to the map and <br />explained what utilities have been installed and where. <br />-4- <br />
