CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 90-179 RESOLUTION CONCERNING THE EARLY POSTING OF POLITICAL CAMPAIGN SIGNS AND URGING ALL CANDIDATES TO COMPLY WITH THIS RESOLUTION WHEREAS, in 1981, the City Council adopted a comprehensive ordinance concerning political signs; and WHEREAS, in adopting that ordinance, the Council found that the purpose of the ordinance was to protect the public from traffic safety hazards, structural sign hazards, aesthetic blight, litter, etc., yet to protect the rights of political candidates and those wishing to support candidates or ballot measures; ;and WHEREAS, to carry out that purpose, the ordinance provides in part that it is unlawful to post a political campaign sign more than 30 days prior to the election for which the sign is posted; and WHEREAS, this portion of the ordinance has been challenged in the United States District Court, Northern district of California, in an action entitled Wallack Campaign Committee, et al. v. Members of the City Council of the City of Pleasanton, et al.; and WHEREAS, it is the belief of the City Council that most candidates will continue to adhere to the 30 day rule now provided in the ordinance but that it would not be the best use of the City's time or resources to keep this portion of the ordinance in effect, and by separate action, the Council has taken steps to repeal that portion of the ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The Council finds and determines that the posting of political campaign signs more than 30 days prior to the election for which the sign is posted causes aesthetic blight, poses a traffic safety hazard, and creates litter. Section 2: The City Council urges that all candidates and all persons supporting/opposing candidates or ballot measures to continue not posting political campaign signs more than 30 days prior to the election.
