CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-179 <br /> <br />RESOLUTION CONCERNING THE EARLY POSTING OF <br />POLITICAL CAMPAIGN SIGNS AND URGING ALL <br />CANDIDATES TO COMPLY WITH THIS RESOLUTION <br /> <br />WHEREAS, <br /> <br />in 1981, the City Council adopted a comprehensive <br />ordinance concerning political signs; and <br /> <br />WHEREAS, <br /> <br />in adopting that ordinance, the Council found that the <br />purpose of the ordinance was to protect the public from <br />traffic safety hazards, structural sign hazards, <br />aesthetic blight, litter, etc., yet to protect the rights <br />of political candidates and those wishing to support <br />candidates or ballot measures; ;and <br /> <br />WHEREAS, <br /> <br />to carry out that purpose, the ordinance provides in part <br />that it is unlawful to post a political campaign sign <br />more than 30 days prior to the election for which the <br />sign is posted; and <br /> <br />WHEREAS, <br /> <br />this portion of the ordinance has been challenged in the <br />United States District Court, Northern district of <br />California, in an action entitled Wallack Campaign <br />Committee, et al. v. Members of the City Council of the <br />City of Pleasanton, et al.; and <br /> <br />WHEREAS, <br /> <br />it is the belief of the City Council that most candidates <br />will continue to adhere to the 30 day rule now provided <br />in the ordinance but that it would not be the best use of <br />the City's time or resources to keep this portion of the <br />ordinance in effect, and by separate action, the Council <br />has taken steps to repeal that portion of the ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The Council finds and determines that the posting of <br />political campaign signs more than 30 days prior to the <br />election for which the sign is posted causes aesthetic <br />blight, poses a traffic safety hazard, and creates <br />litter. <br /> <br />Section 2: <br /> <br /> The City Council urges that all candidates and all <br />persons supporting/opposing candidates or ballot measures <br />to continue not posting political campaign signs more <br />than 30 days prior to the election. <br /> <br /> <br />
