Commissioner Lindsey reiterated that he would like to see 'design' <br />removed from the criteria. Commissioner Wilson indicated design <br />and location should be removed. <br />Mr. Fairfield urged the Commission to consider 'desirability' as <br />determined by the City Council to be a factor in the criteria used. <br />Mr. Levine stated it is necessary to articulate standards and have <br />some reasoning trail to back up one project over another and numbers <br />make it difficult for developers to challenge. He stated that the <br />current RAP program has never been challenged in court and that <br />perhaps we were over concerned initially. <br />Mr. Harris felt it makes sense to have a program which benefits the <br />City and the RAP Ordinance does this and that some projects have <br />built facilities the City really needed. <br />Capital Improvements <br />Barney Knox asked how the capital improvement figure is reached. <br />Mr. Warnick stated that it is a per unit cost of $925. <br />Mr. Harris stated a developer could either contribute the cost to <br />capital improvements or housing or actually provide them. <br />Exemptions <br />Commissioner Wilson addressed exemption for apartment units of 500. <br />Mr. Swift asked for clarification of Mr. Wilson's comments, was he <br />asking for a per project exemption or number per year or for a <br />particular project. <br />Commissioner Wilson indicated 300 apartment limit per project over <br />two years. Commissioner Wilson indicated he liked 150 or 300 but <br />didn't know where the financing would come from. Chairperson Getty <br />said she didn't like the 300 figure when the Planning Commission <br />selected that figure before. Commissioner Wilson said it was based <br />on the fact that no financing is available. <br />After discussion, the Commission agreed unanimously for 150 apartment <br />units per project exemption. <br />One Yiundred fifty (150) rental units with a five year non-conversion <br />clause, subsidized housing, affordable housing also was recommended <br />to be exempt from paying fees. <br />Mr. Knox asked if the ordinance restricts an applicant from filing a <br />condominium plan within 5 years. He said it would be a good idea <br />if they could so that when the time came it wouldn't have to be <br />held up for map approval. <br />Mr. Levine explained why a tentative map is not accepted prior to <br />RAP approval or exemption. <br />-5 - <br />
