Mr. Weimken said he thought they were told that <br />a PUD was the best way to go and the area could be controlled best under <br />this zoning. <br />Commissioner Wilson pointed out that this application is a PUD but that <br />Condition No. 2 proposed no development on the 3.8 acre site until a <br />PUD development plan has come in. <br />Mr. Harris reiterated that what Mr. Black is doing is contrary to the <br />statement made by City Council, but nothing illegal has been done. Ne <br />further indicated that staff was concerned with the precedent setting <br />effect of this application, but that the staff must accept applications. <br />submitted from the .property owners. As to its precedent setting that <br />would be for the Planning Commission and City Council to decide. <br />Mr. Weimken indicated he would hate for the lot split proposal requested <br />by Mr. Black to be a loop hole used by others. <br />Sob Combs, 3730 Camron Drive, was .concerned that if Mr. Black is allowed <br />his proposal the other five or six property owners would request the <br />same thing. <br />Commissioner Wilson asked Mr. Combs if there were. six-eight people who <br />would be applying for this same type of applications because they want <br />to sell their homes. Mr. Combs said they could if they decided to. <br />Commissioner Getty said that approval of this application would not <br />effect the neighborhood. Mr. Combs said if this is approved, he would be <br />able to do the same thing.. <br />t3i11 Skinner, 3715 Mohr Avenue said he owns the five acres next to the <br />Black property. Three weeks ago he had a real estate agent come to <br />Mr. Harris to discuss his property and at that time was told there was <br />to be an overall plan for the entire 35 acres. He stated he was further <br />told up to last week that staff was considering recommending denial of <br />Black's proposal but then didn't. <br />Commissioner Wilson stated that sometimes legal counsel is sought and <br />advice given to staff. <br />Commissioner Wilson asked about the zoning of the property.
