Resolution No. 90-172 <br />Page Two <br /> <br />WHEREAS, <br /> <br />based on the above findings, the City Council is unable <br />to make the necessary findings required under the PUD <br />ordinance of the Pleasanton Municipal Code with regard to <br />the Douglas Harvey/Robert Martin application. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Denies the appeal of Douglas Harvey/Robert Martin of a <br />decision of the Planning Commission which denied approval <br />of Case PUD-89-19, the application for planned unit <br />development rezoning and development plan approval to <br />rezone the property from agricultural to PUD-LDR and to <br />develop a five lot, single family residential development <br />to be located on an approximately 3.8 acre site at 2818 <br />Foothill Road <br /> <br />Section 2: This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING <br />HELD ON SEPTEMBER 18, 1990 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Butler, Mohr, Tarver, and Mayor Mercer <br /> <br />None <br />Councilmember Brandes <br />None <br /> <br />APPROVED AS TOt ,FO~: ~ <br /> <br />Michael H.'
