CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-169 <br /> <br />RESOLUTION AUTHORIZING CITY ATTORNEY TO FIT~ A <br />QUIET TITLE ACTION REGARDING THE REALIGNMENT <br />OF FOOT~ILL ROAD ADJACENT TO THE LAGUNA OAKS <br />SUBDIVISION <br /> <br />WHEREAS, <br /> <br />the City Council conditionally approved PUD-89-5, Laguna <br />Oaks, which approval included a condition that the final <br />development plan include a new alignment plan and <br />vertical profile for Foothill Road from Racoon Hollow <br />Court to Bernal Avenue; and <br /> <br />WHEREAS, <br /> <br />in order to have the proper Foothill Road alignment, the <br />City needs to own a triangular shaped parcel of land, <br />consisting of 18,892.08 square feet, located at the <br />northwest corner of the proposed Laguna Oaks subdivision; <br />and <br /> <br />WHEREAS, title to this property is clouded; and <br /> <br />WHEREAS, <br /> <br />a quiet title action is necessary in order for the City <br />to own this property so that Foothill Road may be <br />properly aligned. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Authorizes the City Attorney to initiate a quiet title <br />action for a triangular shaped parcel of land, consisting <br />of 0.434 acres needed for the Foothill Road realignment <br />adjacent to the Laguna Oaks Subdivision, as described on <br />Exhibit A attached to this resolution. <br /> <br />Section 2: This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br /> <br />
