MINUTES <br />PLANNING COMMISSION <br />June 27, 1984 <br />Page 5 <br />Jim Geranda, 5352 Brookside Court, urged denial of the conditional use permit application. <br />Their property values have suffered. The owners have incurred approximately $75`0,000 of internal <br />damage to their homes. This strongly effects the resale and property values. Many realtors <br />will not handle these townhouse properties. If it is a primary function to protect their private <br />property values, than there is a link to be used. Based on the 150 existing homes having <br />problems, these 24 proposed homes may have problems also and approval would be unfair <br />to all concerned. <br />Commissioner Wilson stated that if he owned one of the units he would have had repairs <br />made to protect his property but then after talking to one of the owners last night, he discovered <br />that an individual homeowner cannot make individual repairs to the roof. Mr. Geranda <br />indicated that this is correct. You cannot fix it yourself because if you do then you become <br />responsible for the next door neighbors roof also. He indicated that to repair the roofs, <br />membranes must be removed. They have two bids ranging from $1,000,000 to $1,070,000. <br />Commissioner Wilson commented that all flat roofs leak. He indicated that the cost to <br />repair the roofs appears to be high. Mr. Geranda indicated that perhaps the bids are high <br />but Stoneson had the ability and roofers in the first place to remedy the situation. Commissioner <br />Wilson pointed out that one could get five bids and have the same person own all five roofing <br />companies.. <br />Jim Carley, 5173 Willow View, is aware of the roof problems while he has none of his own. <br />He disagreed with comments made by Commissioner Wilson that all flat roofs leak. He <br />has lived 30 years in New York with snow and everything else without the roofs leaking. <br />These particular roofs have a design defect and there is no slope to any of them and there <br />are no proper drains. The drains are two inches above the roof level. One must siphon the <br />drains. A reconstruction is needed. He indicated that CC&Rs govern what they can do <br />with the property. The people do not own the roofs. They only own the air space and a small <br />backyard. They have no legal right to repair any of the roofs. Commissioner Wilson suggested <br />that an effort be made to change the rules which govern the homeowners association. It <br />appears to him that the group has a lot of strength. <br />Eleanor Peabody, 5143 Oakdale Court, has been a resident of the townhomes for nine years. <br />They were the twelfth family to move in the units. She was president for three years of <br />the homeowners association and has now been retired from that function for three years. <br />The last time she met with Art Schumacher was in San Francisco and at that meeting he <br />had agreed that if contact was made with an engineer satisfactory to both parties, he would <br />agree to go along with recommendations made. The engineer selected was Walt Glowkowsky. <br />A check of the structures indicated that flashing and other items had not been properly <br />done. The center of the roofs had sunk and water was standing on them. At some point <br />the cooperation stopped and the attitude of Stoneson was to "sue us." She said she went <br />on top of the strucutres with a representative of the building department who was appalled <br />at the condition. Mrs. Peabody indicated she has had a leak in every single room of her <br />house because of lack of calking and workmanship and other things which should have been <br />done. Paper on the roofs now crumbles. Commissioner Wilson asked Mrs. Peabody if she <br />went to the Division of Real Estate or the Contractor's Licensing Board. Mrs. Peabody indicated <br />that while she was president she worked with Stoneson to resolve the problems. <br />-5- <br /> <br />
