CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-165 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF GERALD <br />RILEY AS FILED UNDER CASE FDP-90-1 <br /> <br />WHEREAS, <br /> <br />Gerald Riley has applied for a variance from a <br />requirement in Section 17.08 of the Municipal Code that <br />all structures in special flood hazard areas be <br />constructed with the lowest elevation above the base <br />flood elevation. The applicant is proposing to construct <br />a basement at an elevation below the base flood elevation <br />for the property located at 3506 Kings Canyon Court; and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held September 4, 1990 <br />at which time all public testimony and relevant exhibits <br />were considered; and <br /> <br />WHEREAS, <br /> <br />minor alterations to existing facilities are <br />categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, <br /> <br />the city Council found that the proposed improvement will <br />not adversely affect the public health, safety,and <br />general welfare. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Approves the application of Gerald Riley for a variance <br />from a requirement of the Municipal Code that all <br />structures in specific flood hazard areas be constructed <br />within the lowest elevation above base flood elevation <br />and to allow the construction of a basement at the <br />property located at 3506 Kings Canyon Court, subject to <br />the conditions shown on Exhibit "A" attached hereto and <br />made part of this case by reference. <br /> <br />Section 2: This resolution shall become effective immediately upon <br />its passage and adoption. <br /> <br /> <br />
