2
THE CITY OF
'°°° " -""# "' "`'' ~ ~ ~~~ CITY COUNCIL AGENDA REPORT
PL~E ~S~NTON~
May 1, 2007
City Attorney
TITLE: INITIATION OF AN AMENDMENT TO THE ZONING ORDINANCE TO
DELAY THE EFFECTIVE DATE OF QUASI-ADJUDICATORY
DECISIONS
SUMMARY
Under the Zoning Ordinance, quasi-adjudicatory land use decisions, such as land use
decisions concerning conditional use permits or design review, become effective
immediately. Because of that, those decisions, unlike legislative land use decisions
such as PUD development plans, are not subject to Council reconsideration. City
Council has requested that the staff place on its agenda, for Council consideration, the
initiation of a proposed change to the Zoning Ordinance that would delay the effective
date of quasi-adjudicatory land use decisions such that Council would have the
opportunity to reconsider its decision if it so chose. If Council initiates this change, the
ordinance change would be considered first by the Planning Commission and then
returned to the Council.
RECOMMENDATION
Adopt a motion to initiate a change to the Zoning Ordinance.
FINANCIAL STATEMENT
None.
