2 <br />THE CITY OF <br />'°°° " -""# "' "`'' ~ ~ ~~~ CITY COUNCIL AGENDA REPORT <br />PL~E ~S~NTON~ <br />May 1, 2007 <br />City Attorney <br />TITLE: INITIATION OF AN AMENDMENT TO THE ZONING ORDINANCE TO <br />DELAY THE EFFECTIVE DATE OF QUASI-ADJUDICATORY <br />DECISIONS <br />SUMMARY <br />Under the Zoning Ordinance, quasi-adjudicatory land use decisions, such as land use <br />decisions concerning conditional use permits or design review, become effective <br />immediately. Because of that, those decisions, unlike legislative land use decisions <br />such as PUD development plans, are not subject to Council reconsideration. City <br />Council has requested that the staff place on its agenda, for Council consideration, the <br />initiation of a proposed change to the Zoning Ordinance that would delay the effective <br />date of quasi-adjudicatory land use decisions such that Council would have the <br />opportunity to reconsider its decision if it so chose. If Council initiates this change, the <br />ordinance change would be considered first by the Planning Commission and then <br />returned to the Council. <br />RECOMMENDATION <br />Adopt a motion to initiate a change to the Zoning Ordinance. <br />FINANCIAL STATEMENT <br />None. <br />
