The grantor further understands that the present intention <br />of the grantee is to'construct and maintain a public highway on <br />the lands hereby conveyed in fee and the grantor, for itself, its <br />successors and assigns, hereby waives any claims for any and all <br />damages to grantor's remaining property contiguous to the <br />property hereby conveyed by reason of the location, constr//ction, <br />landscaping or maintenance of said highway, unless such damages <br />are caused by the negligence or willful misconduct of City, its <br />agents, successors and assigns. <br /> <br /> (As used above, the term "grantor" shall include the plural, <br />as well as the singular number and the words "himself" and "his" <br />shall include the feminine gender as the case may be.) <br /> <br /> Excepting therefrom all oil, petroleum, natural gas, mineral rights and other hydrocarbon <br />substances lying below a deDth of 500 vertical feet from the surface of said land, for the purpose <br />of exploring for, extracting, mining, boring, removing of marketing said substances, however, <br />without right of any entry upon the surface of said land, as reserved in the Deed from Gulf Oil <br />Corporation, a corporation, recorded Apri 114, 1977, Instrument No. 77-68934. <br /> <br />EXHIBIT C <br /> <br /> <br />
