BOX 520 PLEASANTON, CA 94566 CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA 91042173 RESOLUTION NO. 90-163B RESOLUTION AUTHORIZING AN EXCHANGE OF PROPERTIES WITH THE MCDONALD'S CORPORATIONAND APPROVAL OF AREAL PROPERTY CONTRACT WHEREAS, the City of Pleasanton has a fee interest in certain real property described in Exhibits A and B attached hereto and incorporated herein by reference; and WHEREAS, in order to complete the interchange at Santa Rita Road and Interstate 580, the City needs to acquire certain property located at the corner of Santa Rita Road and Pimlico Drive, which property is owned by the McDonald's Corporation and is described in Exhibit C attached hereto and incorporated herein by reference; and WHEREAS, City staff has negotiated a R~al Property Contract with the McDonald's Corporation, by which terms the City and McDonald's agree to exchange the properties described above, in addition to the other terms and conditions set forth therein; and WHEREAS, the City Council finds and determines that the exchange of the herein described properties, in conjunction with the other terms and conditions of the Real Property Contract, represent an exchange of properties of equal value. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Manager is hereby authorized to execute on behalf of the City of Pleasanton any and all documents necessary to transfer and receive said properties as provided herein.
