Minutes <br />Planning Commissic <br />10/23/85 <br />area has increased 80~ with a sound wall over the buffer formed <br />by the trees. He urged that Hacienda Business Park make good <br />their promise to install double paned glazing. He has called the <br />Police Department on trucks, tankers and other such vehicles with <br />hazardous materials, etc. He further suggested that McDonalds <br />not be allowed to relocate in this same area. <br />Mr. Swift then reviewed the proposed interchange, relocation of <br />McDonalds, and the requirements of Caltrans and the City for <br />completing the interchange. <br />Norma Kelly 3923 Fairlands Drive indicated there is currently a <br />12' fence which ends partially behind her home. She hears the <br />noises generated by Kindercare. When they built Kindercare the <br />grade was raised 4' and eliminated their privacy. They had a <br />problem with drainage without raising the Kindercare site. They <br />have a one-story home and have a beautiful view of Mt. Diablo. <br />They do not want to look at a wall. Kindercare put in a wall <br />without rebar. She is opposed to a 12' wall. <br />Carl Samuelson, 3929 Fairlands Drive, expressed concern with the <br />proposed location of the dumpster, loading and unloading, noise, <br />food and garbage. They expect the area to be developed but there <br />is an elevation problem. They do not want a 12' high wall <br />either. <br />Commissioner Lindsey addressed the loading/unloading issue and <br />asked if restricting the hours would satisfy him. Mr. Samuelson <br />said it would. Mr. Samuelson said concerning the wall, they need <br />a buffer for privacy but does not want a 12' wall. He felt that <br />the drainage situation is the developer's problem not the <br />homeowners. They are giving the neighbors a 4' problem which <br />they currently do not have. <br />Rose Shoup, represented Kindercare. She stated they are <br />concerned with the height of the building, access to their yard <br />and childrens' safety. They didn't want the height of the <br />structure to block the daylight or for the development to create <br />fumes from automobiles which would effect the children. They do <br />not want any type of business which is open at night such as a <br />7-11 or other convenience type business. <br />Chairman Wilson stated that homeowners of the area are still <br />having problem with the Kindercare development and use. <br />Mr. Baxley stated that Kindercare hasn't been the least bit <br />concerned with his property rights as a neighbor. Kindercare is <br />concerned with security but they can't keep the kids off of his <br />roof. Gates are left open, landscaping hasn't been finished. <br />Access isn't finished on the north side of Pimlico, traffic has <br />been increased. <br />Linda Arnold, 3853 Stratford Court, asked about the interchange <br />improvements. Mr. Swift indicated that the interchange <br />improvements do not take any property south of Pimlico Drive. <br />_. _.... _. .. ___ ...r__ ..__.._ __. ._. ..._ __ T ... <br />
