Mark Sweeney, 4858 Cobbler Court, Pleasanton, addressed the <br />Commission at the invitation of Commissioner Innes. Commissioner <br />Innes then asked Mr. Sweeney what is allowed in the commercial <br />center as he thought all markets were specifically disallowed in <br />the retail centers of Hacienda Business Park. Mr. Swift stated <br />that the PUD approval allows uses as shown in the CN, CR, and CC <br />Districts. The CC&Rs have a much more restrictive set of uses. <br />Mr. Sweeney said they do not intend to allow a supermarket use in <br />Hacienda Business Park. This is restricted through the deeds. <br />Longs Drugs, Safeway, Alpha Beta and others are specifically <br />named in the restrictions as not being allowed. The use proposed <br />in fact, is a large delicatessen with the sale of no drygoods. <br />Commissioner Innes said he would like Condition No. 8 changed so <br />that Buildings #1 and #4 would come back before the Planning <br />Commission and City Council. This will give the City a larger <br />view and see exactly what is happening on site. <br />Chairman Lindsey said he is comfortable with Building No. 1 being <br />worked out with staff. Mr. Swift said staff could review this <br />and it would be brought back as a major or minor modification. <br />Commissioner Innes had a problem with the back of the buildings <br />as currently shown. Chairman Lindsey said this could be worked <br />out with a minor modification. Mr. Swift asked that staff be <br />able to review the elevations with a report back to the Planning <br />Commission. <br />Commissioner Michelotti was concerned with the time frame of the <br />completion of Hopyard improvements and the occupancy of the <br />retail center. Mr. Sweeney stated the construction of the <br />Hacienda Interchange improvements will be completed by December <br />1987 and they will try to insure that intersection improvements <br />are in place when this retail center is occupied. Commissioner <br />Michelotti thanked Mr. Sweeney for addressing this issue. <br />A motion was made by Commissioner Innes, seconded by Commissioner <br />Hoyt to recommend approval of Case PUD-81-30-35D subject to the <br />conditions of the staff report allowing staff to work with the <br />applicant in implementing Condition No. 7, modifying Condition <br />No. 8 to add that the Planning Director shall review and report <br />to the Planning Commission on the appropriateness of the final <br />design for building No. 1 prior to issuance of building permits. <br />This recommendation also included the elimination of Standard <br />Condition No. 9. <br />ROLL CALL VOTE <br />AYES: Commissioners Hoyt, Innes, Michelotti and Chairman <br />Lindsey <br />NOES: None <br />ABSENT: Commissioners Berger and Wellman <br />ABSTAIN: None <br />Resolution No. 2813 was entered and adopted recommending approval <br />of Case PUD-81-30-35D as motioned. <br />- 10 - <br />
