32. The property owner shall enter into an agreement with the City, approved by the <br />City Attorney, which guarantees that all landscaping installed as part of this <br />project, including landscaping in the City right-of-way along the site's Valley <br />Avenue street frontage, will be maintained at all times in a manner consistent <br />with the approved landscape plan for this development. Said agreement shall <br />run with the land for the duration of the existence of the structures located on the <br />property. <br />33. Prior to installation of any signs, a comprehensive sign program shall be <br />submitted for review approval by the Planning Director. Said sign program shall <br />be consistent with the Hopyard Village Shopping Center sign program approved <br />by the City (Case No. PSDR-292) and include the specific regulations for each <br />sign (i.e., colors, materials, illumination, location, sign text, dimensions, etc.). <br />34. At no time shall balloons, banners, pennants, or other attention-getting devices <br />be utilized on the site except as allowed by Section 18.96.060K of the Zoning <br />Ordinance for grand openings or by Section 18.116.040 of the Zoning Ordinance <br />if approved as part of a temporary conditional use permit. At no time shall spot <br />lighting be used in conjunction with such grand openings and/or promotional <br />events. <br />35. The applicants shall install at least one trash receptacle within the sidewalk area <br />along the west or north side of the building. The trash receptacle location and <br />design shall be shown on the plans submitted for issuance of building permits <br />and shall be subject to review and approval by the Planning Director prior to <br />issuance of building permits for the project. <br />36. Prior to installation, the design of the outdoor furniture shall be submitted for the <br />review and approval by the Planning Director. <br />37. Only modular newspaper dispensers accommodating more than one (1) <br />newspaper shall be allowed outside of the building within the development. The <br />design of these dispensers shall be approved by the Planning Director. <br />Dispensers within the public right-of-way shall require an encroachment permit <br />by the Engineering Department. <br />38. There shall be no truck deliveries, parking lot sweeping, or leaf blowing between <br />the hours of 8:00 p.m. and 8:00 a.m. <br />39. Restaurant tenants with cooking facilities shall be equipped at all times with <br />filtering devices to minimize odors and fumes. Details of said devices shall be <br />shown on the tenant improvement plans submitted for issuance of building <br />permits and shall be subject to review and approval by the Planning Director and <br />Chief Building Official prior to issuance of building permits for the tenant <br />improvements. <br />6 <br />
