ORDINANCE NO. 1948 <br />AN ORDINANCE APPROVING THE APPLICATION OF PETER SHUTTS/ <br />GOBLE PROPERTIES FOR A PUD MAJOR MODIFICATION AND <br />DEVELOPMENT PLAN, AS FILED UNDER CASE PUD-85-10-7M <br />WHEREAS, Peter Shutts/Goble Properties has applied for a PUD major <br />modification and development plan to demolish the existing drive-through bank building <br />and related site improvements and construct an approximately 2,530-square-foot, <br />one-story commercial building in its place at the property located at 5765 Valley <br />Avenue; and <br />WHEREAS, zoning for the property is PUD-C-C (Planned Unit Development - <br />Central-Commercial) District; and <br />WHEREAS, the construction of a new commercial building of 10,000 square feet <br />or less in area is categorically exempt (Section 15303, Class 3) from the requirements <br />of the California Environmental Quality Act (CEQA); and <br />WHEREAS, in-fill development projects on sites of five acres or less that have no <br />habitat for endangered, rare, or threatened species, that can be adequately served by <br />all required utilities and public services, that are consistent with the General Plan and <br />zoning regulations, and would have no significant effect on traffic, noise, air quality, or <br />water quality are also categorically exempt (Class 32) from CEQA; and <br />WHEREAS, the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD major modification for the subject site; and <br />WHEREAS, the City Council finds that the project meets the conditions of <br />Class 3 and Class 32 exemptions; and <br />WHEREAS, the City Council further finds that the PUD major modification and <br />development plan are consistent with the General Plan policies and the purposes of <br />the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD-85-10-7M, the application of Peter Shutts/ <br />Goble Properties fora PUD major modification and development plan to <br />demolish the existing drive-through bank building and related site improvements <br />and construct an approximately 2,530-square-foot, one-story commercial building <br />in its place at the property located at 5765 Valley Avenue, subject to the <br />conditions shown on Exhibit B, attached hereto and incorporated herein by this <br />reference. <br />
