CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 90-155 RESOLUTION ADDING TO THE AGENDA AN ITEM TO RETAIN PORTIONS OF THE BROWN ACT WHICH HAVE BEEN RESCINDED WHEREAS, the Ralph M. Brown Act, as amended, requires that the agenda of a City Council be posted 72 hours prior to the meeting and that each regular meeting provide time when the meeting is open to the public; and WHEREAS, the State Legislature and the Governor, in adopting a budget for the State, in essence rescinded those two portions of the Brown Act; and WHEREAS, despite this action, the City Council intends to continue to adhere to the provisions mentioned above; and WHEREAS, the City Council has been requested by a citizen to take formal action on this matter so that there is no question as to the City's stance; and WHEREAS, consideration of such an action was not set forth on the City Council agenda for August 21, 1990; and WHEREAS, the Brown Act permits the Council to add an item to the agenda upon a two-thirds vote of the Council that the item arose after the time the agenda was posted; and WHEREAS, for the reasons expressed above, the City Council finds and determines that this matter did arise after the time the agenda was posted. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The city Council adds to the August 21, 1990 agenda an item concerning the Council's retention of those portions of the Brown Act which have been rescinded by the State Legislature and Governor, as discussed herein. Section 2: This resolution shall become effective immediately upon its passage and adoption.
