CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-155 <br /> <br />RESOLUTION ADDING TO THE AGENDA AN ITEM TO <br />RETAIN PORTIONS OF THE BROWN ACT WHICH HAVE <br />BEEN RESCINDED <br /> <br />WHEREAS, <br /> <br />the Ralph M. Brown Act, as amended, requires that the <br />agenda of a City Council be posted 72 hours prior to the <br />meeting and that each regular meeting provide time when <br />the meeting is open to the public; and <br /> <br />WHEREAS, <br /> <br />the State Legislature and the Governor, in adopting a <br />budget for the State, in essence rescinded those two <br />portions of the Brown Act; and <br /> <br />WHEREAS, <br /> <br />despite this action, the City Council intends to continue <br />to adhere to the provisions mentioned above; and <br /> <br />WHEREAS, <br /> <br />the City Council has been requested by a citizen to take <br />formal action on this matter so that there is no question <br />as to the City's stance; and <br /> <br />WHEREAS, <br /> <br />consideration of such an action was not set forth on the <br />City Council agenda for August 21, 1990; and <br /> <br />WHEREAS, <br /> <br />the Brown Act permits the Council to add an item to the <br />agenda upon a two-thirds vote of the Council that the <br />item arose after the time the agenda was posted; and <br /> <br />WHEREAS, <br /> <br />for the reasons expressed above, the City Council finds <br />and determines that this matter did arise after the time <br />the agenda was posted. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The city Council adds to the August 21, 1990 agenda <br />an item concerning the Council's retention of those <br />portions of the Brown Act which have been rescinded by <br />the State Legislature and Governor, as discussed herein. <br /> <br />Section 2: This resolution shall become effective immediately upon <br /> its passage and adoption. <br /> <br /> <br />
