WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-154A <br /> <br />RESOLUTION SUMMARILY VACATING A PORTION OF <br />FOOTHILL ROAD, AUTHORIZING THE TRANSFER OF <br />SAID PROPERTY TO THE ADJACENTPROPERTY OWNERS, <br />AND REMOVING THE PROHIBITION OF NO ACCESS FROM <br />LOT 2, TRACT 2963 TO THE VACATED PORTION OF <br />FOOTHILL ROAD <br /> <br />pursuant to Chapter 4, Part 3, Division 9 of the <br />California Streets and Highways Code, the City Council <br />may summarily vacate excess right of way of a street or <br />highway, when not required for street or highway purposes <br />(§8334, Streets & Highways Code); and <br /> <br />the City is designing a soundwall and sidewalk along the <br />easterly side of Foothill Road; and <br /> <br />soundwalls are typically installed along the private <br />property lines adjacent to the public right of way; and <br /> <br />due to erosion problems on property located at 4058 <br />Alderwood Court, Pleasanton, CA, owned by Lewis L. and <br />Beryl C. Johnson, the City will be required to construct <br />the soundwall within the existing Foothill Road right of <br />way, thereby creating a portion of the right of way which <br />will be isolated from the remainder of Foothill Road by <br />virtue of the soundwall; and <br /> <br />that portion of Foothill Road which will become isolated <br />by virtue of the construction of the soundwall is <br />described in Exhibit 1 attached to this resolution and <br />incorporated herein by reference; and <br /> <br />that portion of Foothill Road described in Exhibit 1 is <br />no longer needed for right of way purposes and is not <br />usable by anyone other than the Johnsons, the property <br />owners adjacent thereto; and <br /> <br />the Johnsons have agreed to accept that portion of <br />Foothill Road no longer needed by the City; and <br /> <br />as shown on the map for Lot 2, Tract 2963, recorded <br />July 18, 1968, in Book 57 of Maps, Page 62, official <br />Records of Alameda County, there is no access permitted <br />from said Lot 2 to Foothill Road; and <br /> <br />the prohibition of "no access" should be removed along <br />that portion of said Lot 2 which will be immediately <br />adjacent to the vacated portion of Foothill Road. <br /> <br /> <br />
