ROLL CALL VOTE <br />AYES: Commissioners Berger, Hovingh, Mahern, Tarver, <br />and Chairman Hoyt <br />NOES: None <br />ABSENT: Commissioner Michelotti <br />ABSTAIN: None <br />Resolution No. PC-88-72 was entered and denying Case <br />PUD-82-14-8M as motioned. <br />The applicant was advised that he had 15 days in which to appeal <br />the decision to City Council. <br />NEW BUSINESS - Public Hearing <br />------------------------- <br />UP_-B9_-261_Dwyer <br />Application of Robert Dwyer for a conditional use permit to <br />operate a take-out pizza restaurant and related facilities to be <br />located at 43Q1-D Valley Avenue. Zoning for the property is PUD <br />(Planned Unit Development) - Commerical District. <br />Mr. Swift presented the staff report recommending approval of <br />Case UP-88-26. He noted that the conditions set forth are <br />similiar to those for the neighboring Game Station. <br />Commissioner Mahern asked how the number of arcades is <br />determined. Mr. Swift said it is by the applicant's request. <br />Commissioner Tarver asked what type of security there would be. <br />Mr. Swift said it would essentially be the same as it is at <br />present with the police monitoring the location. <br />Discussion of the entry door was had, with Mr. Swift concluding <br />that there would be an emergency exit. <br />The public hearing was opened. <br />Bob Dwyer, 2626 Meadow Glenn Drive, San Ramon 94583, represented <br />the application. He stated that he has read the staff report <br />and agrees with all the conditions. He added that he has driven <br />by the site many times and has also talked with the owner of the <br />Game Station. He agreed to participate in the funding of a <br />security guard. <br />Larry Evans, 2716 Lariat Lane, Walnut Creek, 94596, owner of the <br />Game Station, asked for clarification about the use permit that <br />he has recently received. He wondered whether he would now have <br />to get another one. Mr. Swift responded that it could be done <br />with a series of letters and that another fee would not be <br />accessed. <br />Mr. Evans asked Mr. Swi#t to explain the parking requirements. <br />Mr. Swift explained the ratio of parking, noting that a <br />Page 6 <br />
