southwest of the nose of the ridge whereas in the current plan <br />that was previously disapproved the grading occurs right on the <br />nose of the ridge. It is therefore more to the east than to the <br />west and may or may not be more visible to them, depending where <br />one's house is located. Staff believes that the grading in the <br />approved plan will be visible to all the neighbors. This one <br />will also be very visible to the neighbors and that is why staff <br />is recommending denial of the application. The only other <br />solution appeared to be the planting of very large, very <br />expensive trees in order to obscure the grading. <br />Commissioner Tarver expressed concern that this went to the <br />Council and Council made arrangements and approved a plan and <br />now is back for the Commission to look at again. He is not <br />comfortable with this. He wondered whether there is any way to <br />make everyone satisfied. <br />The public hearing was opened. <br />Thomas Black, 3742 Pinot Court, represented the application. He <br />presented drawings to the Commission and showed overlays of the <br />project. He showed the different locations of the house, <br />cabana, pool, and the various large trees on the site. He <br />showed on the overlay what the neighbors would see and stated he <br />is trying his best to make a favorable view for them. He stated <br />he thought the approved plan was not that much different from <br />the modified one. He said the neighbors have expressed concerns <br />about the grading and that he is trying to work with them, but <br />can't seem to come to an agreement. He also showed the approved <br />plan by City Council. <br />Chairman Michelotti asked Mr. Black to show how the house would <br />be affected if it were slightly elevated. He showed her the <br />approved plan, adding that the difference in grading between the <br />two plans is about 40Q yards. <br />Commissioner Berger asked about the plans they had seen before. <br />Randie Black, co-owner of the project, interjected that the plan <br />shown was not in the packet of October of 1987. She said she <br />doesn't care which plan is approved at this point, but simply <br />wants to go forward. <br />Commissioner Tarver asked Mrs. Black if they have tried to talk <br />to the neighbors about their differences. She responded that <br />she has tried to work it out with the Homeowners Association a <br />number of times to no avail. She said this has been going on <br />for two years and communications were not improving. <br />Commissioner Tarver asked Mrs. Black if Council has said no to <br />the present proposed plan. She responded that no one else has <br />seen the plan. <br />Commissioner Tarver stressed that he felt a cooperative spirit <br />was needed and that this should be worked out with staff. <br />Rage 1b <br />
