Chairperson Michelotti asked Mr. Swift to comment on a reciprocal <br />parking easement with respect to this proposal. Mr. Swift stated <br />that an easement can cease when the use ends, but the use runs <br />with the land. Commissioner Tarver asked if the project could be <br />conditioned with regard to parking. Mr. Swift stated that a <br />License Agreement could be entered into which sometimes is better <br />than an easement. This could cover a specific timeframe and <br />could be set to run with the lease (3 years). If the applicant <br />could get such an agreement in writing, it would be acceptable to <br />staff. Reverend Merritt agreed to attempt to get such an <br />agreement from the property owners to run with the lease. <br />Commissioner Berger asked the name of the owner of the subject <br />property. Reverend Merritt indicated that the property owner is <br />Mr. Osickiā€ž the owner of Sigi's Catering. <br />The public hearing was closed. <br />A motion was made by Commissioner Mahern, seconded by <br />Commissioner Tarver that the findings as shown in the staff <br />report are made and that Case UP-88-27 be approved subject to the <br />conditions thereon with the following changes in conditions: <br />2. That the church shall not operate without obtaining a <br />license agreement for 37 additional parking spaces from <br />adjacent property owners. <br />6. That this conditional use permit is granted subject to a <br />three year staff review and approval. <br />ROLL CALL VOTE <br />AYES: Commissioners Berger, Hovingh, Mahern, Tarver, and <br />Chairman Michelotti <br />NOES: None <br />ABSENT: Commissioner Hoyt <br />ABSTAIN: None <br />Resolution No. PC-88-87 was entered and adopted approving Case <br />UP-88-27 as motioned. <br />PUD-85-15-2D, CurrinfTimm <br />Application of Currin Construction Company and Timm Development, <br />Inc. for development plan approval for a 80-parcel residential <br />project to be located on an approximately 262 acre site located <br />on the west side of Foothill Road approximately 3,100 feet south <br />of the intersection of Bernal Avenue and Foothill Road. Zoning <br />for the property is PUD (Planned Unit Development) - Low Density <br />Residential/Open Space District. <br />Mr. Swift presented the staff report recommending approval of the <br />application subject to the conditions of the staff report as <br />revised. <br />-7- <br />
