5. Create the following minimum criteria for schools, tutoring, and recreation facilities <br />which are proposed to be allowed as permitted uses: <br />• There shall be no more than 20 students inside the facility at any one time; <br />Teaching staff and aids would be additional. <br />• The facility shall adhere to all applicable Federal, State, and local regulations; <br />• The facility shall adhere to all noise requirements of the Pleasanton Municipal <br />Code; <br />• The facility shall adhere to all occupancy, ADA, California Building Code, and <br />exiting requirements; and <br />• The Zoning Administrator finds that adequate parking is available for the said <br />use. <br />The number of students limited to 20 is consistent with many of the conditional use <br />permits that have been processed (Refer to Attachment 4). All of the other <br />conditions are standard conditions of approval. <br />DISCUSSION <br />Staff believes that the proposed Code amendment will provide a streamlined planning <br />process for uses that have no appreciable impact on the City and will allow more <br />opportunity to locate in areas of the City previously not allowed. Refer to the Planning <br />Commission report that provides additional background and research information that <br />the Planning Commission had requested. <br />PUBLIC NOTICE <br />Notice of this application was published in the newspaper. At the time this report was <br />drafted, staff had received one letter in support of the application from the president of <br />the Chamber of Commerce (see Attachment 6). On March 29, 2007 James Paxson, <br />with the Hacienda Owners' Association, called staff and expressed verbal support of the <br />application. <br />ENVIRONMENTAL ASSESSMENT <br />This project is statutorily exempt from the California Environmental Quality Act (CEQA) <br />pursuant to Section 15061(3), and it has been determined that the ordinance will not <br />cause a significant negative effect on the environment. <br />CONCLUSION <br />Staff believes the proposed amendment will allow for more locational opportunities for <br />schools, tutoring, and recreation facilities, and establish an expedited review process for <br />small business owners who provide a niche service to the Pleasanton community. <br />Submitted by: <br />J~icb Stern, Principal Planner <br />for Donna Decker, Acting Director <br />Planning and Community Development <br />Fiscal Review: <br />a <br />David P.
