BACKGROUND <br />On March 20, 2007, in accordance with the weed abatement program provided in <br />Government Code sections 39560 - 39588, the City Council adopted Resolution No. 07- <br />099, which declared that weeds, dirt, rubbish and refuse on specified properties <br />constituted a public nuisance, ordered the abatement thereof, and set a public hearing to <br />hear objections to the proposed abatement. The purpose of this public hearing is to hear <br />and consider these objections, if any. <br />All of the owners of properties included in Resolution No. 07-099 have been mailed a <br />notice of the order to abate the nuisance on their parcels and a notice of this protest <br />hearing. For reference, a copy of the property list included as Exhibit A to Resolution <br />No. 07-099 is also included as Exhibit A to the resolution attached to this agenda report. <br />In accordance with Government Code section 39567.1, the notices were mailed to the <br />property owner as provided in the last equalized assessment roll available on March 20, <br />2007, the date of the adoption of Resolution No. 07-099. Each notice was sent with an <br />introductory letter, a list of weed abatement standards and a proof of service. The proof <br />of service was included to certify what documents were sent to the property owners. <br />DISCUSSION <br />At this hearing, after considering any and all objections to the proposed abatement, the <br />City Council should overrule the objections to the proposed abatement and/or move to <br />amend the list of properties to be abated. The City Council should then adopt the <br />attached resolution, as amended (if at all), that orders a contractor to abate the weeds <br />on the properties enumerated in Resolution No. 07-099. <br />After this hearing, the Livermore-Pleasanton Fire Department inspectors will re-survey <br />the parcels listed in Resolution No. 07-099. If abatement has not occurred by May 31, <br />2007, a contractor will abate the weeds.
