CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-144 <br /> <br />RESOLUTION DENYING A 3.5 FOOT HEIGHT <br />INCREASE FOR A PORTION OF A BUILDING AT <br />6700 SANTA RITA ROAD AS FILED UNDER CASE <br />PUD-80-15-SD-2M <br /> <br />WHEREAS, <br /> <br />Pleasant Village Associates applied for a major <br />modification to an approved retail commercial <br />complex, which modification in part, sought <br />permission to increase a portion of the retail <br />complex by three and a half feet; and <br /> <br />WHEREAS, <br /> <br />zoning for the property is PUD (Planned Unit <br />Development) - Commercial District; and <br /> <br />WHEREAS, <br /> <br />projects of this nature proposing minor physical <br />changes to approved plans are categorically exempt <br />from the requirements of CEQA; and <br /> <br />WHEREAS, <br /> <br />at its duly noticed public hearing of July 17, <br />1990, the Council considered the recommendation of <br />the City staff, the Planning Commission and <br />considered all public testimony and relevant <br />exhibits; and <br /> <br />WHEREAS, <br /> <br />the Council continued this matter until July 23, <br />1990; and <br /> <br />WHEREAS, <br /> <br />at its meeting of July 23, 1990, Council considered <br />further public testimony and exhibits. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: That portion of the major modification, as filed <br /> under Case PUD-80-15-5D-2M, which would have <br /> permitted a portion of the retail complex at 6700 <br /> Santa Rita Road to be increased by three and a half <br /> feet is denied. <br /> <br />Section 2: <br /> <br /> Staff is directed to take appropriate steps to <br />cause the applicant to modify the development plans <br />to provide that with respect to the portion of the <br />retail complex in question, the building height <br />limit be 26 feet in front and 21.5 feet in the <br /> <br />rear. <br /> <br /> <br />
