10. <br /> <br />11. <br /> <br />Bakers Square shall abide by all underlying conditions and <br />requirements of the "Measure X" approval of PUD-80-15-5D to <br />the satisfaction of the Director of Planning. <br /> <br />The existing driveway on Santa Rita Road, which is part of <br />the proposed major modification covered by PUD-80-15-5D-2M, <br />shall be limited to right turn in and out vehicle movements. <br />The property owner of PUD-80-15-5D-2M is required under that <br />application to provide on-site signage and other appropriate <br />means as required by the City Engineer to accomplish this <br />objective, and to apply to CalTrans for an encroachment <br />permit for all work to be done in the Santa Rita Road right- <br />of-way. If the PUD-$0-15-5D-2M application fails, or the <br />property owner of PUD-80-15-2M-5D fails to make the above- <br />mentioned changes to the Santa Rita Road driveway by the time <br />of occupancy of Bakers Square, then the owner of the Bakers <br />Square project site shall be responsible for effecting the <br />Santa Rita Road driveway changes as required by the City <br />Engineer, and to secure the encroachment permit from <br />CalTrans. <br /> <br />The neon lighting encircling the building and turrets at its <br />roof may be reviewed by the City Council following its <br />installation in order to limit its intrusiveness to <br />residential neighbors located to the south and east of the <br />site. Council may, following this review, require the neon <br />lighting to be reduced in intensity and/or removed from those <br />areas visible from these residences. Alternatively, the <br />applicant may delete the neon lighting from those areas <br />visible from neighboring residences prior to constructing the <br />building. <br /> <br />-2- <br /> <br /> <br />
