10.

11.

Bakers Square shall abide by all underlying conditions and
requirements of the "Measure X" approval of PUD-80-15-5D to
the satisfaction of the Director of Planning.

The existing driveway on Santa Rita Road, which is part of
the proposed major modification covered by PUD-80-15-5D-2M,
shall be limited to right turn in and out vehicle movements.
The property owner of PUD-80-15-5D-2M is required under that
application to provide on-site signage and other appropriate
means as required by the City Engineer to accomplish this
objective, and to apply to CalTrans for an encroachment
permit for all work to be done in the Santa Rita Road right-
of-way. If the PUD-$0-15-5D-2M application fails, or the
property owner of PUD-80-15-2M-5D fails to make the above-
mentioned changes to the Santa Rita Road driveway by the time
of occupancy of Bakers Square, then the owner of the Bakers
Square project site shall be responsible for effecting the
Santa Rita Road driveway changes as required by the City
Engineer, and to secure the encroachment permit from
CalTrans.

The neon lighting encircling the building and turrets at its
roof may be reviewed by the City Council following its
installation in order to limit its intrusiveness to
residential neighbors located to the south and east of the
site. Council may, following this review, require the neon
lighting to be reduced in intensity and/or removed from those
areas visible from these residences. Alternatively, the
applicant may delete the neon lighting from those areas
visible from neighboring residences prior to constructing the
building.

-2-
