Ordinance No. <br />Page 2 <br />1. A clinic licensed pursuant to Chapter 1 of Division 2 of the California <br />Health & Safety Code, as amended. <br />2. A health care facility licensed pursuant to Chapter 2 of Division 2 of the <br />California Health & Safety Code, as amended. <br />3. A residential care facility for persons with chronic life-threatening illness <br />licensed pursuant to Chapter 3.01 of Division 2 of the California Health & <br />Safety Code, as amended. <br />4. A residential care facility for the elderly licensed pursuant to Chapter <br />3.2 of Division 2 of the California Health & Safety Code, as amended. <br />5. A hospice or a home health agency, licensed pursuant to Chapter 8 of <br />Division 2 of the California Health & Safety Code, as amended. <br />C. "Person with an Identification Card" shall have the meaning given that term by <br />California Health & Safety Code §11362.7, as amended. <br />D. "Primary Caregiver" shall have the meaning given that term by California Health <br />& Safety Code §11362.7, as amended. <br />E. "Qualified Patient" shall have the meaning given that term by California Health & <br />Safety Code § 11362.7, as amended. <br />6.18.020 Operation of Medical Marijuana Dispensaries Prohibited. <br />No person shall operate or permit to be operated a Medical Marijuana Dispensary in or <br />upon any premises in the city. <br />6.18.030 Penalty. <br />Any person violating any of the provisions of this Chapter shall be guilty of a <br />misdemeanor. Any person convicted of a misdemeanor under the provisions of this <br />Chapter shall be punished by a fine of not more than one thousand dollars ($1,000.00) <br />or by imprisonment for a period not exceeding six (6) months, or by both such fine and <br />imprisonment. Each such person shall be guilty of a separate offense for each and <br />every day during any portion of which any violation of any provision of this Chapter is <br />committed, continued or permitted by such person and shall be punished accordingly. <br />Section 2. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br />Section 3. This ordinance shall be effective thirty (30) days after its passage <br />and adoption. <br />
