ORDINANCE NO. 1947 <br />AN ORDINANCE APPROVING THE APPLICATION OF MICHAEL AMINIAN <br />AND MOHSEN SADRI FOR PUD DEVELOPMENT PLAN APPROVAL, AS <br />FILED UNDER CASE PUD-56 <br />WHEREAS, Michael Aminian and Mohsen Sadri have applied for PUD <br />development plan approval to allow three new single-family homes on an approximately <br />2.45-acre parcel located at 865 Clara Lane; and <br />WHEREAS, zoning for the property is PUD-LDR/OS (Planned Unit Development- <br />Low Density Residential/Open Space) District; and <br />WHEREAS, an environmental review for the proposed project was undertaken <br />with the Environmental Impact Report (EIR) for the Vineyard Avenue Corridor Specific <br />Plan, certified by the City Council on March 1999; and <br />WHEREAS, the California Environmental Quality Act (CEQA) specifies that <br />individual residential development projects that are prepared pursuant to the <br />requirements of an adopted specific plan, for which an EIR has been prepared and <br />certified, are exempt from additional environmental review; and <br />WHEREAS, at its meeting of March 6, 2007, the City Council received the <br />Planning Commission's positive recommendations for approval of the PUD <br />development plan; and <br />WHEREAS, a duly noticed public hearing was held on March 6, 2007; and <br />WHEREAS, after a review of the materials presented, the City Council finds that <br />the PUD development plan is consistent with the General Plan policies and the <br />purposes of the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD-56, the application of Michael Aminian and <br />Mohsen Sadri for PUD development plan approval to allow three new <br />single-family homes on an approximately 2.45-acre parcel located at 865 Clara <br />Lane, subject to the conditions shown on Exhibit B, attached hereto and <br />incorporated herein by this reference. <br />SECTION 2. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall <br />be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days <br />after its adoption. <br />
